|In the light of market developments, it is appropriate to further define packages on the basis of alternative objective criteria which predominantly relate to the way in which the travel services are presented or purchased and where travellers may reasonably expect to be protected by this Directive. That is the case, for instance, where different types of travel services are purchased for the purpose of the same trip or holiday from a single point of sale and those services have been selected before the traveller agrees to pay, that is to say within the same booking process, or where such services are offered, sold or charged at an inclusive or total price, as well as where such services are advertised or sold under the term ‘package’ or under a similar term indicating a close connection between the travel services concerned. |It should be clarified that travel services combined after the conclusion of a contract by which a trader entitles a traveller to choose among a selection of different types of travel services, such as in the case of a package travel gift box, constitute a package. While those arrangements should not constitute packages within the meaning of this Directive, under which one organiser is liable for the proper performance of all travel services, such linked travel arrangements constitute an alternative business model that often competes closely with packages. | |

It should be clarified that where other tourist services are added, for instance, to hotel accommodation, booked as a stand-alone service, after the traveller’s arrival at the hotel, this should not constitute a package. Član 71. |4.2. Garancija putovanja
Garancijom putovanja usled insolventnosti organizatora putovanja posebno se obezbeđuju troškovi nužnog smeštaja, ishrane i povratka putnika sa putovanja u mesto polaska u zemlji i inostranstvu, kao i sva nastala potraživanja putnika.
Garancijom putovanja radi naknade štete obezbeđuje se naknada štete koja se prouzrokuje putniku neispunjenjem, delimičnim ispunjenjem ili neurednim ispunjenjem obaveza organizatora putovanja, koje su određene opštim uslovima i programom putovanja.
Korisnik garancije putovanja je lice koje u skladu sa ovim zakonom ima pravo na naknadu troškova i to:
1) lice koje je izmirilo troškove nužnog smeštaja, ishrane i povratka putnika sa putovanja u mesto polaska;
2) putnik u slučaju neispunjenja, delimičnog ispunjenja ili neurednog ispunjenja obaveza organizatora putovanja, koje su određene opštim uslovima i programom putovanja.
Garanciju putovanja u propisanom iznosu, organizator putovanja mora da ima za sve vreme trajanja licence.
Garancijom putovanja ne mogu se ograničiti prava lica iz člana 59. ovog zakona na naknadu u skladu sa ovim zakonom.
Sva turistička putovanja prodata u periodu trajanja licence i izdate garancije putovanja obezbeđuju se iz te garancije, bez obzira na period realizacije turističkog putovanja.
Ministar bliže propisuje vrstu, visinu i uslove garancije putovanja, način aktiviranja, kao i druge uslove koje mora da ispuni organizator putovanja.
Opštim uslovima putovanja uređuju se prava i obaveze organizatora putovanja i prava i obaveze putnika.
Opšti uslovi putovanja sadrže:
1) pravo organizatora putovanja na naknadu stvarnih troškova ako je putnik odustao od ugovora zbog okolnosti koje nije mogao izbeći ili otkloniti i koje bi da su postojale u vreme zaključenja ugovora predstavljale opravdan razlog da ne zaključi ugovor;
2) pravo organizatora putovanja na naknadu administrativnih troškova kada je putnik obezbedio odgovarajuću zamenu ili je zamenu našao sam organizator;
3) pravo organizatora putovanja na naknadu administrativnih troškova kada je putnik blagovremeno, pre roka predviđenog opštim uslovima putovanja, otkazao turističko putovanje;
4) odgovornost organizatora putovanja kada izvršenje usluga iz programa putovanja poveri trećim licima;
5) prava putnika za slučaj otkaza putovanja;
6) uslove za izmenu ugovora o putovanju, pre otpočinjanja putovanja;
7) podatke o garanciji putovanja, odnosno informacije o osiguranim slučajevima i instrumentima obezbeđenja, kao i načinu njihovog aktiviranja;
8) postupak, rokove i obaveze organizatora putovanja u vezi sa reklamacijom putnika zbog otkaza putovanja, neizvršenja ili nepotpunog izvršenja usluga obuhvaćenih programom putovanja.
Izuzetno od stava 2. tačka 2) ovog člana ako lice kome je poverena usluga prevoza zahteva naknadu za promenu imena putnika ili poništavanje karte i izdavanje nove, organizator putovanja ima pravo i na naknadu tih troškova.
Pravo na naknadu iz stava 3. ovog člana organizator putovanja ostvaruje samo u slučaju kada se ti troškovi obrazloženo dokumentuju.
Podaci o garanciji putovanja, odnosno informacije o osiguranim slučajevima i instrumentima obezbeđenja, kao i načinu njihovog aktiviranja iz stave 2. tačke 7) ovog člana moraju biti posebno uokvireni.
U slučaju izmene bitnih elemenata ugovora o putovanju, koje je putnik prihvatio, turistička agencija je dužna da nova dokumenta ugovora o putovanju uruči putniku na način propisan članom 76. stav 1. ovog zakona, uz potvrdu prijema.
Dokumenta iz stava 6. ovog člana, smatraće se novim ugovorom o putovanju.

|Organizator putovanja je dužan da:
1) svaku promenu podataka iz člana 57. tačka 1), 5) i 6) ovog zakona prijavi Registru turizma u roku od 7 dana;
2) utvrdi opšte uslove putovanja i da izradi program putovanja, u pisanoj formi (štampanoj, elektronskoj ili na trajnom nosaču zapisa) i da ih se pridržava;
3) prodaje program putovanja koji je pripremljen na osnovu zaključenog ugovora sa trećim licima, kojima je povereno izvršenje usluga iz tog programa putovanja;
4) za svakog putnika, odnosno ugovoreno turističko putovanje obezbedi garanciju putovanja;
5) u propisanom obliku, sadržini i načinu vodi evidenciju izdatih garancija putovanja;
6) u slučaju otkaza putovanja od strane organizatora putovanja putniku izvrši povraćaj uplaćenih sredstava u roku od 15 dana;
7) putniku vrati razliku između ugovorene cene putovanja i cene putovanja snižene srazmerno neizvršenju ili nepotpunom izvršenju usluga u roku od 15 dana, u slučaju neizvršenja ili nepotpunog izvršenja usluga obuhvaćenih programom putovanja, na propisan način;
8) putniku vrati uplaćena sredstva u slučaju otkaza putovanja od strane putnika, u visini određenoj opštim uslovima putovanja, u roku od 15 dana od dana otkaza putovanja;
9) obezbedi smeštaj putnika za sve vreme trajanja putovanja;
10) obezbedi povratak putnika na odredište;
11) se stara da putnici ne budu neopravdano zadržani na putovanju duže nego što je predviđeno programom putovanja;
12) angažuje tokom celog turističkog putovanja najmanje jednog turističkog pratioca ili turističkog vodiča za turističku grupu, a po prevoznom sredstvu kojim se obavlja usluga prevoza;
13) angažuje predstavnika na turističkoj destinaciji za turističku grupu, ako na destinaciji nisu angažovana lica iz tačke 12) ovog stava;
14) za one putnike, koji ne čine turističku grupu, omogući kontakt za hitne slučajeve sa određenim lokalnim predstavnikom ili agencijom;
15) za pružanje usluge turističkog vodiča, turističkog pratioca ili lokalnog turističkog vodiča, angažuje lice koje ispunjava uslove iz člana 89. stav 1. i člana 95. stav 1. ovog zakona;
16) za predstavnika na turističkoj destinaciji angažuje lice koje ispunjava uslove iz člana 102. ovog zakona.
Organizator putovanja je odgovoran za realizaciju turističkog putovanja.
Opšti uslovi putovanja se utvrđuju u skladu sa ovim zakonom, a na pitanja koja nisu posebno uređena ovim zakonom shodno se primenjuju odgovarajuće odredbe zakona kojim se uređuje zaštita potrošača i zakona kojim se uređuju obligacioni odnosi.

|U slučaju izmene bitnih elemenata ugovora o putovanju, koje je putnik prihvatio, turistička agencija je dužna da nova dokumenta ugovora o putovanju uruči putniku na način propisan članom 76. stav 1. ovog zakona, uz potvrdu prijema.
Dokumenta iz stava 6. ovog člana, smatraće se novim ugovorom o putovanju.
Turistička agencija je dužna da sva dokumenta iz ugovora o putovanju uruči putniku neposredno, elektronskim putem ili na trajnom nosaču zapisa, uz potvrdu putnika o prijemu tih dokumenata (potpisom ili elektronskim putem).
Izuzetno može doći do promene prodajne cene samo u slučaju nastupanja novih okolnosti, koje u trenutku prodaje, odnosno ugovaranja turističkog putovanja turističkoj agenciji nisu mogle biti poznate (povećanje cene goriva, uvođenja novih taksi na destinaciji i sl.).

The traveller should be entitled to have problems resolved and, where a significant proportion of travel services included in the package travel contract cannot be provided, the traveller should be offered suitable alternative arrangements. If the organiser does not remedy the lack of conformity within a reasonable period set by the traveller, the traveller should be able to do so himself and request reimbursement of the necessary expenses. In certain cases there should not be a need to specify a time-limit, in particular if immediate remedy is required. This would apply, for instance, when, due to the delay of a bus provided by the organiser, the traveller has to take a taxi to catch his flight on time. Travellers should also be entitled to a price reduction, termination of the package travel contract and/or compensation for damages. Dokumenta iz stava 6. ovog člana, smatraće se novim ugovorom o putovanju.

14) za one putnike, koji ne čine turističku grupu, omogući kontakt za hitne slučajeve sa određenim lokalnim predstavnikom ili agencijom;
15) za pružanje usluge turističkog vodiča, turističkog pratioca ili lokalnog turističkog vodiča, angažuje lice koje ispunjava uslove iz člana 89. stav 1. i člana 95. stav 1. ovog zakona;
16) za predstavnika na turističkoj destinaciji angažuje lice koje ispunjava uslove iz člana 102. ovog zakona.

|Garancijom putovanja usled insolventnosti organizatora putovanja posebno se obezbeđuju troškovi nužnog smeštaja, ishrane i povratka putnika sa putovanja u mesto polaska u zemlji i inostranstvu, kao i sva nastala potraživanja putnika.
Garancijom putovanja radi naknade štete obezbeđuje se naknada štete koja se prouzrokuje putniku neispunjenjem, delimičnim ispunjenjem ili neurednim ispunjenjem obaveza organizatora putovanja, koje su određene opštim uslovima i programom putovanja.
Korisnik garancije putovanja je lice koje u skladu sa ovim zakonom ima pravo na naknadu troškova i to:
1) lice koje je izmirilo troškove nužnog smeštaja, ishrane i povratka putnika sa putovanja u mesto polaska;
2) putnik u slučaju neispunjenja, delimičnog ispunjenja ili neurednog ispunjenja obaveza organizatora putovanja, koje su određene opštim uslovima i programom putovanja.
Garanciju putovanja u propisanom iznosu, organizator putovanja mora da ima za sve vreme trajanja licence.
Garancijom putovanja ne mogu se ograničiti prava lica iz člana 59. ovog zakona na naknadu u skladu sa ovim zakonom.
Sva turistička putovanja prodata u periodu trajanja licence i izdate garancije putovanja obezbeđuju se iz te garancije, bez obzira na period realizacije turističkog putovanja.
Ministar bliže propisuje vrstu, visinu i uslove garancije putovanja, način aktiviranja, kao i druge uslove koje mora da ispuni organizator putovanja.

However, effective insolvency protection should not have to take into account highly remote risks, for instance the simultaneous insolvency of several of the largest organisers, where to do so would disproportionately affect the cost of the protection, thus hampering its effectiveness. |Pojedini izrazi upotrebljeni u ovom zakonu imaju sledeće značenje:
izlet je kombinacija dve ili više turističkih usluga (prevoz i druge turističke usluge), koje je utvrdila turistička agencija samostalno ili po zahtevu putnika, u trajanju kraćem od 24 sata, koja ne uključuje noćenje, a koje turistička agencija prodaje po jedinstvenoj ceni;
Sindikalne organizacije, udruženja penzionera, ferijalne, studentske, izviđačke i planinarske organizacije i ustanove socijalne i dečje zaštite, kao i druga udruženja i organizacije (u daljem tekstu: organizacija), mogu samo za svoje članove, odnosno korisnike, u skladu sa svojim statutom, organizovati putovanje za sopstvene potrebe ili izlet (u daljem tekstu: putovanje), bez svrhe sticanja dobiti.
Organizacija je dužna da utvrdi godišnji plan putovanja (u daljem tekstu: plan putovanja) i dostavi ga turističkoj inspekciji, u roku od sedam dana, od dana usvajanja.
Plan putovanja koji nije dostavljen turističkoj inspekciji smatraće se kao da nije ni donet.
Plan putovanja aktom usvaja nadležni organ organizacije, utvrđen statutom.
Organizacija koja je utvrdila plan putovanja dužna je da istovremeno sa planom putovanja dostavi turističkoj inspekciji osnivački akt i statut, podatke o broju članova, dokaz o upisu u odgovarajući registar, odnosno evidenciju, kao i akt iz člana 84. stava 4. ovog zakona.
U slučaju promene plana putovanja organizacija je dužna da novi plan putovanja dostavi turističkoj inspekciji najkasnije pet dana od dana usvajanja tog plana.
U slučaju promene dokumenata i podataka iz stava 1. ovog člana organizacija je dužna da nova dokumenta i podatke dostavi turističkoj inspekciji najkasnije pet dana od dana nastanka promene.
Organizacija može da realizuju samo ona putovanja koja su predviđena planom putovanja i kojima se ostvaruju ciljevi utvrđeni osnivačkim aktom, odnosno statutom.
Organizacija je dužna da svako putovanje prijavi turističkoj inspekciji, najkasnije pet radnih dana pre otpočinjanja putovanja.
Uz prijavu iz stava 2. ovog člana organizacija je u obavezi da dostavi program putovanja sa bitnim elementima iz člana 72. stav 1. ovog zakona, spisak putnika sa dokazom o članstvu i dr.
Organizacija je dužna da u programu putovanja posebno uokviri obaveštenje da za putovanje nije obezbeđena zaštita u pogledu garancija putovanja.
Putovanje se ne može javno oglašavati i reklamirati, osim davanja obaveštenja članovima odnosno korisnicima.
Organizacija je dužna da vodi evidenciju ugovora i podataka iz ugovora zaključenih sa trećim licima kojima je povereno izvršenje usluga prevoza, smeštaja, usluga turističkih profesija i drugih usluga iz programa putovanja.
Organizacija je dužna da za svako putovanje vodi i evidenciju koja naročito sadrži:
1) podatke o putniku (ime, prezime, broj članske karte sa datumom izdavanja i dr.);
2) mesto, datum i vreme početka i završetka putovanja, opis odredišta putovanja i periode boravka sa datumima;
3) podatke o vrsti prevoza i svojstvima prevoznog sredstva koje se koristi;
4) podatke o smeštajnom objektu (vrsta i naziv, lokacija i kategorija prema važećim propisima zemlje u kojoj se objekat nalazi i sadržaje koje objekat ima);
5) podatke o broju noćenja, vrsti i broju usluga i ukupnom broju dana putovanja;
6) prodajnu cenu putovanja sa uslugama, koje su obuhvaćene tom cenom;
7) cenu onih fakultativnih usluga, koje nisu obuhvaćene prodajnom cenom;
8) način i dinamiku plaćanja putovanja;
9) cilj i svrhu putovanja, usaglašeni sa aktom o osnivanju, odnosno statutom.
Evidencije iz st. 1. i 2. ovog člana vode se po načelima urednosti i tačnosti, na način koji ne dozvoljava brisanje unetih podataka i kojim se omogućava uvid u podatke po hronološkom redu.
Ugovori i dokumentacija iz stava 1. ovog člana moraju biti na srpskom jeziku.
Izuzetno od stava 3. ovog člana ugovori i dokumentacija mogu biti na stranom jeziku, ali je organizacija dužna da na zahtev organa obezbedi njihov prevod.
Podaci sadržani u ugovoru iz stava 1. ovog člana moraju biti istiniti.
Dokumentacija iz st. 1. i 2. ovog člana može se čuvati na trajnom nosaču zapisa.
Putovanje koje nije u planu putovanja ili podaci o putovanju koji nisu evidentirani na način iz člana 87. st. 1. i 2. ovog zakona, a imaju elemente turističkog putovanja u smislu ovog zakona smatraće se turističkim putovanjem, za čije je organizovanje i realizovanje potrebna licenca iz člana 54. ovog zakona.

Član 65.
|turističko putovanje jeste kombinacija dve ili više turističkih usluga (prevoz, smeštaj i druge turističke usluge), koje je utvrdio ili pripremio organizator putovanja samostalno ili po zahtevu putnika, u trajanju dužem od 24 sata ili u kraćem trajanju ako uključuje jedno noćenje, kao i jedno ili više noćenja koji uključuje samo uslugu smeštaja u određenom terminu ili vremenskom trajanju koje se prodaje po jedinstvenoj ceni;
Turistička agencija koja prodaje uslugu putniku elektronskim putem posluje u skladu sa ovim zakonom i zakonom kojim se uređuje elektronska trgovina.
Turistička agencija iz stava 1. ovog člana dužna je da ispuni posebne uslove, kao i da elektronsku prodaju turističkog putovanja, izleta i drugih usluga u turizmu vrši na propisan način.
Turistička agencija iz stava 2. ovog člana mora da ima registrovan nacionalni internet domen Republike Srbije preko koga prodaje usluge.
Turistička agencija iz stava 1. ovog člana na svojoj internet stranici, odnosno web prezentaciji mora vidno da objavi sledeće podatke:
poslovno ime i matični broj;
adresu, sedište, odnosno ogranak ili izdvojeno mesto;
kontakt podatke (telefon, imajl adresa i dr.);
broj licence;
garanciju putovanja, osiguravača, rok važenja garancije (skadenca);
opšte uslove putovanja;
program putovanja koji se prodaje, sa propisanim elementima;
ime i prezime i kontakt lica zaduženog za prijem reklamacije;
broj tekućeg računa turističke agencije.
Ako turistička agencija posredstvom društvenih mreža, drugih sajtova i sl., daje obaveštenje o turističkom putovanju, izletu i drugim uslugama koje pruža, dužna je da ispuni uslove iz stava 4. ovog člana.
Ministar propisuje posebne uslove koje treba da ispuni turistička agencija koja prodaje usluge posredstvom interneta, kao i način elektronske prodaje turističkog putovanja, izleta i drugih usluga u turizmu.

|Prema vrsti poslova koje obavljaju turističke agencije mogu biti:
turistička agencija organizator turističkog putovanja (u daljem tekstu: organizator putovanja).
Turistička agencija obavlja poslove:
1) organizovanja, realizovanja i prodaje turističkih putovanja u zemlji i u inostranstvu;
2) organizovanja, realizovanja i prodaje putovanja učenika i studenata u inostranstvo radi učenja stranog jezika ili stručnog usavršavanja sa mogućnošću obavljanja privremenih i povremenih poslova;
3) prodaje i posredovanja u prodaji turističkih putovanja;
4) prihvata, prevoza i transfera putnika;
5) organizovanja izleta, turističkih razgledanja, zabavnih programa i slično, kao i posredovanja u organizovanju skupova, sajmova, manifestacija i sportskih priredbi;
6) pružanja, odnosno, posredovanja u pružanju usluga turističkih vodiča, turističkih pratilaca, lokalnih turističkih vodiča i turističkih animatora;
7) pribavljanja putnih isprava, rezervacije i prodaje putnih karata u ime i za račun domaćih i stranih prevoznika;
8) rezervacije turističkih, ugostiteljskih i drugih usluga u vezi sa putovanjem i boravkom putnika;
9) posredovanja u prodaji ugostiteljskih ili turističkih usluga;
10) posredovanja u iznajmljivanju motornih vozila;
11) rezervacije i prodaje karata za sportske, kulturne i druge priredbe i manifestacije;
12) zastupanja u osiguranju putnika i prtljaga u skladu sa zakonom kojim se uređuje osiguranje;
13) prodaje turističkih publikacija i drugo;
14) zamene strane valute (menjačke poslove);
15) druge poslove uobičajene u turističkom prometu.
Organizator putovanja može da obavlja poslove iz člana 52. stav 1. ovog zakona, ako ispunjava uslove propisane ovim zakonom.

Posrednik može da obavlja poslove iz člana 52. stav 1. tač. 3) do 15) ovog zakona, ako ispunjava uslove propisane ovim zakonom.

Article 5.1. |INFORMATION OBLIGATIONS AND CONTENT OF THE PACKAGE TRAVEL CONTRACT
1.Member States shall ensure that, before the traveller is bound by any package travel contract or any corresponding offer, the organiser and, where the package is sold through a retailer, also the retailer shall provide the traveller with the standard information by means of the relevant form as set out in Part A or Part B of Annex I, and, where applicable to the package, with the following information:
(a) the main characteristics of the travel services: (i) the travel destination(s), itinerary and periods of stay, with dates and, where accommodation is included, the number of nights included; (ii) the means, characteristics and categories of transport, the points, dates and time of departure and return, the duration and places of intermediate stops and transport connections. Where the exact time is not yet determined, the organiser and, where applicable, the retailer shall inform the traveller of the approximate time of departure and return; (iii) the location, main features and, where applicable, tourist category of the accommodation under the rules of the country of destination; (iv) the meal plan; (v) visits, excursion(s) or other services included in the total price agreed for the package; (vi) where it is not apparent from the context, whether any of the travel services will be provided to the traveller as part of a group and, if so, where possible, the approximate size of the group; (vii) where the traveller’s benefit from other tourist services depends on effective oral communication, the language in which those services will be carried out; and (viii) whether the trip or holiday is generally suitable for persons with reduced mobility and, upon the traveller’s request, precise information on the suitability of the trip or holiday taking into account the traveller’s needs;
(b) the trading name and geographical address of the organiser and, where applicable, of the retailer, as well as their telephone number and, where applicable, e-mail address;
(c) the total price of the package inclusive of taxes and, where applicable, of all additional fees, charges and other costs or, where those costs cannot reasonably be calculated in advance of the conclusion of the contract, an indication of the type of additional costs which the traveller may still have to bear;
(d) the arrangements for payment, including any amount or percentage of the price which is to be paid as a down payment and the timetable for payment of the balance, or financial guarantees to be paid or provided by the traveller;
(e) the minimum number of persons required for the package to take place and the time-limit, referred to in point (a) of Article 12(3), before the start of the package for the possible termination of the contract if that number is not reached;
(f) general information on passport and visa requirements, including approximate periods for obtaining visas and information on health formalities, of the country of destination;
(g) information that the traveller may terminate the contract at any time before the start of the package in return for payment of an appropriate termination fee, or, where applicable, the standardised termination fees requested by the organiser, in accordance with Article 12(1);
(h) information on optional or compulsory insurance to cover the cost of termination of the contract by the traveller or the cost of assistance, including repatriation, in the event of accident, illness or death. For package travel contracts concluded by telephone, the organiser and, where applicable, the retailer shall provide the traveller with the standard information set out in Part B of Annex I, and the information set out in points (a) to (h) of the first subparagraph. | | |NU | |Član 93. Turistička agencija je dužna da u slučaju iz st. 1, 2. i 3. ovog člana postupi saglasno odredbama zakona kojim se uređuje oblast osiguranja. |PU | | | |Article 7.1. |Content of the package travel contract and documents to be supplied before the start of the package

The traveller shall be entitled to request a paper copy if the package travel contract has been concluded in the simultaneous physical presence of the parties. With respect to off-premises contracts as defined in point 8 of Article 2 of Directive 2011/83/EU, a copy or confirmation of the package travel contract shall be provided to the traveller on paper or, if the traveller agrees, on another durable medium.

Član 76. stav 1. |Opšti uslovi putovanja se utvrđuju u skladu sa ovim zakonom, a na pitanja koja nisu posebno uređena ovim zakonom shodno se primenjuju odgovarajuće odredbe zakona kojim se uređuje zaštita potrošača i zakona kojim se uređuju obligacioni odnosi.
Tekst ugovora o putovanju, odnosno opšti uslovi putovanja, program putovanja i potvrda o putovanju, moraju da budu štampani slovnim znacima i brojevima koji su jednake veličine ali ne manjim od standardne veličine 12.
Turistička agencija je dužna da sva dokumenta iz ugovora o putovanju uruči putniku neposredno, elektronskim putem ili na trajnom nosaču zapisa, uz potvrdu putnika o prijemu tih dokumenata (potpisom ili elektronskim putem).
|PU | | | |7.2. |2.The package travel contract or confirmation of the contract shall set out the full content of the agreement which shall include all the information referred to in points (a) to (h) of the first subparagraph of Article 5(1) and the following information: (a) special requirements of the traveller which the organiser has accepted; (b) information that the organiser is: (i) responsible for the proper performance of all travel services included in the contract in accordance with Article 13; and (ii) obliged to provide assistance if the traveller is in difficulty in accordance with Article 16; (c) the name of the entity in charge of the insolvency protection and its contact details, including its geographical address, and, where applicable, the name of the competent authority designated by the Member State concerned for that purpose and its contact details; (d) the name, address, telephone number, e-mail address and, where applicable, the fax number of the organiser’s local representative, of a contact point or of another service which enables the traveller to contact the organiser quickly and communicate with him efficiently, to request assistance when the traveller is in difficulty or to complain about any lack of conformity perceived during the performance of the package; (e) information that the traveller is required to communicate any lack of conformity which he perceives during the performance of the package in accordance with Article 13(2); (f) where minors, unaccompanied by a parent or another authorised person, travel on the basis of a package travel contract which includes accommodation, information enabling direct contact with the minor or the person responsible for the minor at the minor’s place of stay; (g) information on available in-house complaint handling procedures and on alternative dispute resolution (‘ADR’) mechanisms pursuant to Directive 2013/11/EU of the European Parliament and of the Council (1), and, where applicable, on the ADR entity by which the trader is covered and on the online dispute resolution platform pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council (2); (h) information on the traveller’s right to transfer the contract to another traveller in accordance with Article 9. |Član 71.

Član 76. stav 2. |Opštim uslovima putovanja uređuju se prava i obaveze organizatora putovanja i prava i obaveze putnika.
Opšti uslovi putovanja sadrže:
pravo organizatora putovanja na naknadu stvarnih troškova ako je putnik odustao od ugovora zbog okolnosti koje nije mogao izbeći ili otkloniti i koje bi da su postojale u vreme zaključenja ugovora predstavljale opravdan razlog da ne zaključi ugovor;
pravo organizatora putovanja na naknadu administrativnih troškova kada je putnik obezbedio odgovarajuću zamenu ili je zamenu našao sam organizator;
pravo organizatora putovanja na naknadu administrativnih troškova kada je putnik blagovremeno, pre roka predviđenog opštim uslovima putovanja, otkazao turističko putovanje;
odgovornost organizatora putovanja kada izvršenje usluga iz programa putovanja poveri trećim licima;
prava putnika za slučaj otkaza putovanja;
uslove za izmenu ugovora o putovanju, pre otpočinjanja putovanja;
podatke o garanciji putovanja, odnosno informacije o osiguranim slučajevima i instrumentima obezbeđenja, kao i načinu njihovog aktiviranja;
postupak, rokove i obaveze organizatora putovanja u vezi sa reklamacijom putnika zbog otkaza putovanja, neizvršenja ili nepotpunog izvršenja usluga obuhvaćenih programom putovanja.
Izuzetno od stava 2. tačka 2) ovog člana ako lice kome je poverena usluga prevoza zahteva naknadu za promenu imena putnika ili poništavanje karte i izdavanje nove, organizator putovanja ima pravo i na naknadu tih troškova.
Pravo na naknadu iz stava 3. ovog člana organizator putovanja ostvaruje samo u slučaju kada se ti troškovi obrazloženo dokumentuju.
Podaci o garanciji putovanja, odnosno informacije o osiguranim slučajevima i instrumentima obezbeđenja, kao i načinu njihovog aktiviranja iz stave 2. tačke 7) ovog člana moraju biti posebno uokvireni.
U slučaju izmene bitnih elemenata ugovora o putovanju, koje je putnik prihvatio, turistička agencija je dužna da nova dokumenta ugovora o putovanju uruči putniku na način propisan članom 76. stav 1. ovog zakona, uz potvrdu prijema.
Dokumenta iz stava 6. ovog člana, smatraće se novim ugovorom o putovanju.
Program putovanja turističke agencije sadrži informacije o svim elementima turističkog putovanja i to:
redni broj i naziv programa putovanja iz propisane evidencije;
naziv organizatora putovanja, poslovno ime i sedište;
broj licence;
mesto, datum i vreme početka i završetka putovanja, opis odredišta putovanja i periode boravka sa datumima ako je boravak u delovima;
podatke o vrsti prevoza i svojstvima prevoznog sredstva koje se koristi;
podatke o smeštajnom objektu (vrsta, naziv i kategorija prema važećim propisima zemlje u kojoj se objekat nalazi, sadržaje koje objekat ima i dr.);
podatke o smeštajnoj jedinici (soba, studio, apartman,) opremljenost, nivo komfora i usluga, kao i ostale karakteristike;
podatke o broju i vrsti ležaja u smeštajnoj jedinici, kao i druge karakteristike uslova smeštaja;
podatke o broju noćenja, vrsti i broju usluga i ukupnom broju dana turističkog putovanja;
broj, vrstu i način usluživanja obroka;
prodajnu cenu turističkog putovanja sa uslugama, koje su obuhvaćene tom cenom;
cenu onih fakultativnih usluga, koje nisu obuhvaćene prodajnom cenom;
način i dinamiku plaćanja;
posebne obaveze putnika koje su uslov za realizaciju putovanja (zdravstvene, carinske i granične formalnosti, administrativne i vizne, kao i dokumenta i rokovi neophodni za pribavljanje viza i sl.);
minimalni broj putnika, ako je to uslov za realizaciju putovanja i krajnji rok za obaveštavanje putnika za slučaj otkazivanja.
Turistička agencija je u obavezi da nakon izrade programa putovanja iz stava 1. ovog člana isti numeriše, overi i odloži po hronološkom redu u poseban registar.
Prilikom izrade dokumenta, koji pod istim nazivom i za istu destinaciju sadrži više različitih programa putovanja u pogledu vrste smeštajnog objekta, uslova smeštajne jedinice, prevoznog sredstva, termina i dr. numeracija se može vršiti istim brojem.
Poseban registar iz stava 2. ovog člana može se voditi na način propisan članom 67. stav 6. ovog zakona.
Turistička agencija nakon prodatog turističkog putovanja u programu putovanja ne može da vrši izmene elemenata iz stava 1. ovog člana.
Naziv turističkog putavanja ne može da sadrži reči iz programa putovanja koje se odnose na fakultativnu uslugu.
Ako usluga iz programa turističkog putovanja (prisustvo umetničkim, kulturnim, sportskim i drugim manifestacijama) čini svrhu putovanja, turistička agencija je u obavezi da obezbedi izvršenje usluge.
Turistička agencija može putniku da stavi na raspolaganje brošuru, koja mora da sadrži istinite podatke.
Turistička agencija je u obavezi da prilikom prodaje turističkog putovanja pored opštih uslova putovanja i programa putovanja putniku uruči potvrdu o putovanju.
Potvrda o putovanju, pored podataka o organizatoru putovanja (naziv, poslovno ime, sedište, broj licence i sl.), sadrži podatke o putniku (ime, prezime, adresa, kontakt telefon i sl.), destinaciji, nazivu smeštajnog objekta, datumu početka i završetka putovanja, broju noćenja, vrsti i broju usluga, ukupnom broju dana turističkog putovanja, podatke o vrsti prevoza, prodajnoj ceni, kao i ceni onih usluga koje ne čine obavezni elemenat programa putovanja i dr.
Potvrda o putovanju sadrži mesto, datum izdavanja, kao i potpise ugovornih strana.
Potvrda o putovanju mora da sadrži i podatke o garanciji putovanja sa podacima potrebnim za njeno aktiviranje.
Pre otpočinjanja turističkog putovanja turistička agencija je u obavezi da putniku neposredno, elektronskim putem ili na trajnom nosaču zapisa da podatke o licu na destinaciji ovlašćenom za pružanje obaveštenja i uputstava i zaštite prava putnika za sve vreme trajanja turističkog putovanja (ime i prezime, kontakt telefon, e-mail adresa i dr.), odnosno kontakt podatke o lokalnom predstavniku ili agenciji iz člana 68. tačka 13) ovog zakona.

Transfer of the package travel contract to another traveler
1.Member States shall ensure that a traveller may, after giving the organiser reasonable notice on a durable medium before the start of the package, transfer the package travel contract to a person who satisfies all the conditions applicable to that contract. Notice given at the latest seven days before the start of the package shall in any event be deemed to be reasonable.

|Termination of the package travel contract and the right of withdrawal before the start of the package
1.Member States shall ensure that the traveller may terminate the package travel contract at any time before the start of the package. Where the traveller terminates the package travel contract under this paragraph, the traveller may be required to pay an appropriate and justifiable termination fee to the organiser. The package travel contract may specify reasonable standardised termination fees based on the time of the termination of the contract before the start of the package and the expected cost savings and income from alternative deployment of the travel services. In the absence of standardised termination fees, the amount of the termination fee shall correspond to the price of the package minus the cost savings and income from alternative deployment of the travel services. prava putnika za slučaj otkaza putovanja;
uslove za izmenu ugovora o putovanju, pre otpočinjanja putovanja;
podatke o garanciji putovanja, odnosno informacije o osiguranim slučajevima i instrumentima obezbeđenja, kao i načinu njihovog aktiviranja;
postupak, rokove i obaveze organizatora putovanja u vezi sa reklamacijom putnika zbog otkaza putovanja, neizvršenja ili nepotpunog izvršenja usluga obuhvaćenih programom putovanja.
Izuzetno od stava 2. tačka 2) ovog člana ako lice kome je poverena usluga prevoza zahteva naknadu za promenu imena putnika ili poništavanje karte i izdavanje nove, organizator putovanja ima pravo i na naknadu tih troškova.
Pravo na naknadu iz stava 3. ovog člana organizator putovanja ostvaruje samo u slučaju kada se ti troškovi obrazloženo dokumentuju.
Podaci o garanciji putovanja, odnosno informacije o osiguranim slučajevima i instrumentima obezbeđenja, kao i načinu njihovog aktiviranja iz stave 2. tačke 7) ovog člana moraju biti posebno uokvireni.
U slučaju izmene bitnih elemenata ugovora o putovanju, koje je putnik prihvatio, turistička agencija je dužna da nova dokumenta ugovora o putovanju uruči putniku na način propisan članom 76. stav 1. ovog zakona, uz potvrdu prijema.
Dokumenta iz stava 6. ovog člana, smatraće se novim ugovorom o putovanju.

Organizator putovanja je dužan da bez odlaganja otkloni svako odstupanje od prodatog turističkog putovanja, odnosno da najkasnije u roku od osam dana od dana prijema reklamacije pisanim ili elektronskim putem odgovori putniku na izjavljenu reklamaciju.
Način podnošenja reklamacije, evidencija, postupanje po podnetoj reklamaciji i dr. turistička agencija vodi u skladu sa propisima, kojima se uređuje oblast zaštite potrošača.

4.Without prejudice to the exceptions laid down in paragraph 3, if the organiser does not remedy the lack of conformity within a reasonable period set by the traveller, the traveller may do so himself and request reimbursement of the necessary expenses. It shall not be necessary for the traveller to specify a time-limit if the organiser refuses to remedy the lack of conformity or if immediate remedy is required.

| |13.5. |5.Where a significant proportion of the travel services cannot be provided as agreed in the package travel contract, the organiser shall offer, at no extra cost to the traveller, suitable alternative arrangements of, where possible, equivalent or higher quality than those specified in the contract, for the continuation of the package, including where the traveller’s return to the place of departure is not provided as agreed. Where the proposed alternative arrangements result in a package of lower quality than that specified in the package travel contract, the organiser shall grant the traveller an appropriate price reduction. The traveller may reject the proposed alternative arrangements only if they are not comparable to what was agreed in the package travel contract or the price reduction granted is inadequate.

If it is impossible to make alternative arrangements or the traveller rejects the proposed alternative arrangements in accordance with the third subparagraph of paragraph 5 of this Article, the traveller is, where appropriate, entitled to price reduction and/or compensation for damages in accordance with Article 14 without terminating the package travel contract. 7.As long as it is impossible to ensure the traveller’s return as agreed in the package travel contract because of unavoidable and extraordinary circumstances, the organiser shall bear the cost of necessary accommodation, if possible of equivalent category, for a period not exceeding three nights per traveller. Where longer periods are provided for in Union passenger rights legislation applicable to the relevant means of transport for the traveller’s return, those periods shall apply.

Turistička agencija je dužna da:
19) korisniku usluge omogući podnošenje reklamacije;
Opšti uslovi putovanja sadrže:
8) postupak, rokove i obaveze organizatora putovanja u vezi sa reklamacijom putnika zbog otkaza putovanja, neizvršenja ili nepotpunog izvršenja usluga obuhvaćenih programom putovanja.
U slučaju neizvršenja ili nepotpunog izvršenja usluga obuhvaćenih programom putovanja putnik može da izjavi reklamaciju u roku od mesec dana od dana nastanka nepravilnosti ili osam dana od dana završetka putovanja.
Organizator putovanja je dužan da bez odlaganja otkloni svako odstupanje od prodatog turističkog putovanja, odnosno da najkasnije u roku od osam dana od dana prijema reklamacije pisanim ili elektronskim putem odgovori putniku na izjavljenu reklamaciju.

15) za pružanje usluge turističkog vodiča, turističkog pratioca ili lokalnog turističkog vodiča, angažuje lice koje ispunjava uslove iz člana 89. stav 1. i člana 95. stav 1. ovog zakona;
16) za predstavnika na turističkoj destinaciji angažuje lice koje ispunjava uslove iz člana 102. ovog zakona.
Pre otpočinjanja turističkog putovanja turistička agencija je u obavezi da putniku neposredno, elektronskim putem ili na trajnom nosaču zapisa da podatke o licu na destinaciji ovlašćenom za pružanje obaveštenja i uputstava i zaštite prava putnika za sve vreme trajanja turističkog putovanja (ime i prezime, kontakt telefon, e-mail adresa i dr.), odnosno kontakt podatke o lokalnom predstavniku ili agenciji iz člana 68. tačka 13) ovog zakona.

Article 17.1.
|Effectiveness and scope of insolvency protection
1.Member States shall ensure that organisers established in their territory provide security for the refund of all payments made by or on behalf of travellers insofar as the relevant services are not performed as a consequence of the organiser’s insolvency. If the carriage of passengers is included in the package travel contract, organisers shall also provide security for the travellers’ repatriation. Continuation of the package may be offered. Organisers not established in a Member State which sell or offer for sale packages in a Member State, or which by any means direct such activities to a Member State, shall be obliged to provide the security in accordance with the law of that Member State.

|2.Before the traveller is bound by any contract leading to the creation of a linked travel arrangement or any corresponding offer, the trader facilitating linked travel arrangements, including where the trader is not established in a Member State but, by any means, directs such activities to a Member State, shall state in a clear, comprehensible and prominent manner that the traveller: (a) will not benefit from any of the rights applying exclusively to packages under this Directive and that each service provider will be solely responsible for the proper contractual performance of his service; and (b) will benefit from insolvency protection in accordance with paragraph 1.
