PREDLOG ZAKONA

O POTVRĐIVANJU MEMORANDUMA O RAZUMEVANJU IZMEĐU

VLADE REPUBLIKE SRBIJE I UJEDINJENIH NACIJA O DOPRINOSU SISTEMU „STAND BY” ARANŽMANA UJEDINJENIH NACIJA

Član 1.

Potvrđuje se Memorandum o razumevanju između Vlade Republike Srbije i Ujedinjenih nacija o doprinosu sistemu „stand by” aranžmana Ujedinjenih nacija, koji je potpisan 22. novembra 2011. godine, u Njujorku, u originalu na engleskom jeziku.

Član 2.

Tekst Memoranduma u originalu na engleskom jeziku i u prevodu na srpski jezik glasi:

MEMORANDUM OF UNDERSTANDING

BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SERBIA

AND THE UNITED NATIONS

CONCERNING

CONTRIBUTIONS TO THE UNITED NATIONS STAND-BY ARRANGEMENTS SYSTEM

The Government of the Republic of Serbia

and

The United Nations,

Hereinafter referred to as “the Parties”,

Recognizing the need to expedite the provision of certain resources to the United Nations in order to effectively implement in a timely manner, the mandate of the United Nations peacekeeping operations authorized by the Security Council,

Further recognizing that the advantages of pledging resources for peacekeeping operations contribute to enhancing flexibility and low costs,

Have reached the following understanding:

Article I

Purpose

The purpose of the present Memorandum of Understanding is to identify the resources which the Government of the Republic of Serbia has indicated that it will provide to the United Nations for use in United Nations peacekeeping operations under the conditions as specified in this Memorandum of Understanding.

Article II

Description of resources

1. The detailed description of the resources to be provided by the Government of the Republic of Serbia is set out in the Annex to the present Memorandum of Understanding. The said Annex may be periodically changed with the consent of the Ministry of Defence of the Republic of Serbia and the United Nations Department of Peacekeeping Operations.

2. In the preparation of the Annex, as in the case of its amendments, it is necessary to observe the guidelines for the provision of resources for United Nations Peacekeeping Operations.

Article III

Condition of provision

The final decision on deploying the resources, remains a national decision of the Republic of Serbia.

Article IV

Modifications

The present Memorandum of Understanding may be modified at any time by mutual consent of the Parties, in writing. The modifications shall be applied and take effect in accordance with Article V of this Memorandum of Understanding.

Article V

Entry into effect

This Memorandum of Understanding shall be provisionally applied as of the day of signature and shall enter into force on the day of the receipt of the notification by which the Republic of Serbia through diplomatic channels informs the United Nations that it has concluded the procedure necessary for this Memorandum of Understanding to enter into force in accordance with its national legislation.

Article VI

Termination

This Memorandum of Understanding may be terminated at any time by either Party. The termination takes effect three (3) months upon the day of the receipt of such a notification.

Signed in New York on 22. November 2011, in two originals, in the English language, both texts being equally authentic.

Član 3.

Ovaj zakon stupa na snagu osmog dana od dana objavljivanja u „Službenom glasniku Republike Srbije ( Međunarodni ugovori”.

OBRAZLOŽENJE

1. Ustavni osnov za donošenje Zakona

Ustavni osnov za donošenje Zakona o potvrđivanju Memoranduma o razumevanju između Vlade Republike Srbije i Ujedinjenih nacija o doprinosu sistemu „stand by” aranžmana Ujedinjenih nacija, sadržan je u članu 99. stav 1. tačka 4. Ustava Republike Srbije, kojim je propisano da Narodna skupština potvrđuje međunarodne ugovore kad je zakonom predviđena obaveza njihovog potvrđivanja.

2. Razlozi za potvrđivanje Memoranduma

Memorandum o razumevanju između Vlade Republike Srbije i Ujedinjenih nacija o doprinosu sistemu „stand by” aranžmana Ujedinjenih nacija, čije se potvrđivanje predlaže ovim zakonom, opredeljuju se ciljevi i principi na kojima će se zasnivati saradnja u oblasti doprinosa Republike Srbije sistemu „stand by” aranžmana Ujedinjenih nacija.

Takođe, ovaj memorandum je jedan od preduslova za angažovanje kapaciteta, odnosno resursa Republike Srbije u mirovnim operacijama Ujedinjenih nacija. Ovaj sistem Ujedinjenih nacija, predstavlja bazu podataka i definisanje kapaciteta koji se stavljaju na raspolaganje Ujedinjenim nacijama. Navedeni kapaciteti angažuju se u multinacionalnim operacijama pod mandatom Ujedinjenih nacija i to nakon poziva Ujedinjenih nacija za konkretnu misiju i saglasnosti Republike Srbije.

3. Ocena potrebnih finansijskih sredstava za sprovođenje Zakona

Za sprovođenje ovog zakona nisu potrebna dodatna finansijska sredstva, budući da se sredstva koja su potrebna za sprovođenje Memoranduma, predviđaju finansijskim planom Ministarstva odbrane.
